Cagayan de Oro City_The Commission on Elections has filed a motion, Tuesday, F
December 17, 2024, to withdraw the petition for disqualification versus CdO 1st District Congressional candidate Raineir Jaiquin Velez Uy, the incumbent Barangay Chairman of Barangay Carmen, this City. Earlier, the Comelec prayed for the disqualification of candidate Uy based on Section 68 of the Omnibus Election Code , in relation to Section 261(e) of the same Code.
In a two-page motion, the Comelec prayed for the withdrawal of the instant case based on recent information received by the petitioner and cited the need to re-assess the documents and evidence presented, as well as a further investigation of the case, if warranted. The petitioner has opted to evaluate the disqualification petition filed, stressing the commission's mandate to properly and faithfully enforce and administer laws relative to ensuring free, orderly, and honest elections.
The Comelec, in considering that their re-assessment and further investigation of the disqualification petiton may alter the course of the instant case, and in the interest of justice and fairness,has moved for the withdrawal of the petition.
